I wonder if any states have exceptions for an outdoor covered smoking area set apart from the main store.
Quick look and Dept of Health states; “The Department of Health recommends that the designated area for smoking be located in an area away from building entrances, windows or openings, and have appropriate containers for ash and cigarette disposal.” That being said it just needs to be 20’ away from openings and it seems legal.

Seems standard with online retailers now. Iwan Ries was the first to charge tax maybe five years ago, the SP about three years ago, and PC about a year ago. I'm not sure how the tax money is handed around between states, but I think you don't get off tax-free anymore just because you're buying online.

As for smoking in restaurants, I'd rather sacrifice that and do my smoking elsewhere after a meal than have the strong smell of someone else's tobacco wafted over my meal, modest or expensive. I don't want a Marlboro cigarette with my hamburger nor someone else's cigar with my steak.

The French are big smokers but very strict in the sense that if you light up between courses, some waiters will end your meal. Smoking comes after dessert and any after dinner drinks. No exceptions. Never mind, the food is always worth it. When in France.

Worst is that a B&M can’t move there and just open a tobacco/cigar shop since they’ve basically outlawed new stores that you can smoke in. If you don’t want smokers in a store don’t go to a cigar/pipe B&M. I don’t drink but I’m not offended by ordering food in a bar. Crazy!

The realty is the owner of a Missouri business decides if more customers are offended by smoking or more by absence of ashtrays.

And tobacco shops with gross sales of over 50% tobacco products are exempt.

Why don’t more tobacco online retailers move here?

My guess is Missouri would impose their ten per cent tax even on online sellers shipping out of state.

As a result, about every little town offers a pack of Half and Half for $3.49 and cheap cigarettes for $2 a pack, in at least one bricks and mortar retail store, alongside cheap booze. Every gas station sells 99 cent airline bottles of name brand booze, too.

I’m also guessing when marijuana is legal we’ll protect our local stoners and weed merchants.

Girls have to go across the Kansas or Illinois line to resolve female problems, but otherwise Missouri is surprisingly sin friendly.:)

Excise tax goes to the state in which the transaction was initiated. So, the buyer pays to tax to the state in which he or she lives.

Every state is hungry for voluntary donations like excise taxes on products that are not strict necessities, like alcohol, tobacco, lotteries, casino fees, and now these days, the wonderful medicinal marijuana!

Isn’t it a blessed coincidence marijuana peddlers chose the address of the farm owned by Governor Mike Parson to build a medical cannabis cultivation factory so large that you could fly a drone inside of three enormous barns, and still growing?

And then Sac Osage Electric built an enormous power sub station by the barns! Glory be, what a miracle!

I own a home in Humansville my mother built brand new in 2001 when she moved from the farm to town. My local city taxes are so cheap I forget what they are, maybe $30? Less than one Lee Star Grade, anyway.

The home across the street is abandoned.

The back yard fence conceals an abandoned mobile home.

Three homes to the South there’s a shack with big Pitt Bull dogs chained up that has big signs NO TRESPASSING and BEWARE OF DOG and WE DON’T CALL 911 with a pistol pointed at you.

Ragged little children play in the streets littered with dollar whiskey bottles.

Humansville is a low tax paradise, but you’d never want to live there.

At the request of Flora Farms, they were annexed into the city of Humansville.

This made them quite popular in the Governor’s Mansion, I’m sure.:)

Just guessing, but I think all the online retailers of tobacco are located where tobacco farmers are really popular.

I’m 64 years old, and I’m the youngest person in Humansville that can take you right to where, the last moonshine still in the Ozark foothills was. It’s about two miles south of Big Tussle, in Spout Spring Hollow, just across the Polk County line.

There are four different Thunder Roads a mountain boy could chose to leave that site.:)



Edgar “Uncle Joe” Buchanan was Humansville’s most famous resident before Governor Mike Parson.

Taxes are, a necessary good.

They educate little hillbillies, in all the little Humansvilles.

A few years ago, an old lady approached me in a pawn shop.

She was circulating a ballot initiative petition for a 15 cent state sales tax.

Missouri has this sales tax now.

The state sales tax rate is 4.225%. Cities, counties and certain districts may also impose local sales taxes as well, so the amount of tax sellers collect from the purchaser depends on the combined state and local rate at the location of the seller.

She said it would make it a Fair Tax.


Fairer to lawyers like me, not a little old lady on social security spending every dime she makes every month.:)

Let the lawyers tally up the sin taxes.

The historical transfer of real estate from the lower 50% to the upper 10% is a direct result of real estate taxes. Real estate ownership should have been exempted from taxation by the Constitution.

If I owned a tobacco shop and the state required me to collect excise tax for them, I wouldn't pay them a dime. I would never apply for a retail license and if they didn't catch it which most states don't I would be a ghost. I was a ghost for 20 years I would roll the dice, put the money into a safety deposit box. If ever audited I do my Mickey the Dunce act and pretend I was a moron bordering on retardation and ask them what is an excise tax. Do I have to pay it to the mfg. Do I have to pay it to the growers? Do I have to pay it to my customers> I just don't understand, can you help me understand as I would never do anything against the law. If they audit you and that is a big if. if you play the game right, you can get away with it for decades.

Just make sure you check to make sure you could never go to jail for it and the worst they can do is fine or penalize you. Ang good accountant or lawyer can advice you on how to do it. don't lay down for these tax slime, you need to find out the most important things that trigger an audit. Home offices, righting off gas for your car, all kinds of mickle and dime shit that raises flags, do your due diligence before you begin,
Also never sign any paperwork that your accountant and attorney have not read. The IRS doesn't need to know you have both waiting in the wings, use the Mickey the Dunce act first. Trust me it works.

My local independent pipe shop got locally grandfathered into having a smoking table in the shop where people can sit and smoke pipes and cigars. The crowning touch is a note taped to the glass on the front door written in pencil stating that if you enter, you may encounter tobacco smoke. The whole deal is astonishingly human and right-minded. It makes it an even more special place.
