Im glad your daughter only broke an arm and, then there's the emotional stuff. Im a law talking guy(lawyer), often defense. Passing the field sobriety test may let someone argue they weren't impaired but I doubt it will keep them from charges. The breath test on the scene isn't admissible in my state but it is reason enough to arrest on a charge, then take you to Station to blow into the breath test machine there that is reliable enough bring into Court. I'm sure she will get charged with something and pay restitution for the accident. The state DOT will probably suspend the driver's license.

Cosmic, you might send a level-headed letter to the board of directors at the hospital describing the claiming of your tamper, describing the item and its lack of weapon potential, and calling into question the security decision and stating a reasonable value for the item. You could even include a photo of a similar tamper to illustrate. I think taken out of the policing context, its appropriation will offend a majority of the board members. It was decorated with gold and stones, for heavens sake. It was the wrong call, and you were mugged, and most people could understand that. Next they'll be confiscating peoples' gold chains and wedding bands as potential brass knuckles. Given an accurate retail value and ask to be reimbursed.

Man, I have a couple of twenty-somethings and I have been through some very serious heart wrenching crap, too: this is to say, I comprehend the gravity and how it weighs. My thoughts are with you and yours (and your tamp).
I have trouble understanding how that 'field' test (merely a perception judgment) could override the blow test (an empirical chemical test)! One would think the reverse would apply.

My second son was born at hone (accidentally), and when my oldest and I got to the hospital following the ambulance of my wife and new baby, we ran in like my hair was on fire. Security stopped me and I tried to rush past saying,"My wife and son just arrived in an ambulance." The guard said, "Calm down sir, and empty your pockets." They took my Swiss Army knife I was carrying, but returned it when I left.

I'd ask to speak to the security supervisor and see if you can "find out the process to recover your property."

With regards the tamper,to my simple mind it is theft pure and simple.

Yes I understand the idea of potential weapons but a tamper ?

Is there not a way to request it back from the hospital/security if not charge them with theft of your property and demand compensation of the value

glad that your kid is doing well and recovering, I bet it was some hell of a night!! good thing you had your pipe, to help calm the nerves, do you have pictures of the tamp that was taken away of the security? I bet it was a beautiful piece of art.

She will go again today to see the surgeon. She can't move any fingers, and they won't use pins to set the small pieces of bone because at her age the bones are still growing. I'm having a little anxiety about how they will set such a shattered bone. They only did a temporary cast at the Children's ER.
Also, my cousin and lawyer is checking with B'ham PD to see how to get my tamp back, and handle my claims concerning the accident. The Children's Hospital is in downtown B'ham and they use Birmingham City police as security, not a security company. And there were no shrubs or even dirt outside, just to be clear. Nowhere to hide it, except homeless people and concrete. My cousin knows a few people on the force that may help. If not, I am NOT freaking out or worrying about the tamp. I've already started making a few more out of silver. I think that I'll save any future gold scraps for Christmas presents, ha hA.

Mike I know the feeling, Daughter was a passenger in a very bad wreck, she was ok, but I didn't know that at the time, was at work, jumped in Truck and tore to the Hospital, no parking place in Emj lot but Drs, parked in one, got out hurring Guard ran saying No,No, I kept on, he grabbed me bad mistake , not proud how I handled it, ran into the cubicles and saw my daughter sitting on a Gurney, full of debris but not hurt. My Heart went in my throat , by that time Security came.I let them move me out. They let me have a phone call, my wife's best friend Son was Clerk of court and had given her a number for Dire Emj use, called it, about 1/2 hr later handcuffs came off and I apologized to Guard. Daughter was ok, I would have done anything I was so happy.

I'm applying for a job at emergency room security to I can confiscate objects that can be weaponized like peoples' eyeglasses, shoes, jewelry and belts, with pawn dealers and car-trunk fences as my retail outlet. I like suppliers who are helplessly distracted by injured or ill family members. Why don't I think a pipe nail would have been grabbed? I think the sapphires were the obvious "weapon" to be resold, I mean sequestered. Maybe I could grab a wheelchair from time to time, walkers, canes, prostheses, glass eyes, dentures (they might bite someone), toupees (might smother someone), etc. The business model just keeps growing. If I saw someone in a suit my size, that might have to go.
Not sarcastically: I'll keep on sending healing thoughts and prayers.

Toodfreak, the hospital is in downtown Birmingham, between a homeless shelter and a few adult bookstores down the road. I have no facts, but I imagine the temptation for a junky to come in desperate for a fix might be a threat. I have no idea whether this has happened. Then, add in children with abusers, held hostage in parental divorce disputes, and crazy people in general. BPD handles a lot of security for different high risk places in town.

All in all, I am not a fan of the way Children's Hospital treats parents, no matter what the issue. It is my opinion that the hospital hires only jerks and assholes for all non medical positions.

There are hectic times at security check points, but as a general matter, the staff has time on their hands. I see no reason why most objects retained by security couldn't be returned, like my 2 1/4 inch blade pocket knife, which in fact was returned with no problem. I'm trying to think what the issue to the contrary might be. Handguns and long-blade knives, I'll leave that to the legal staff, but pocket items that have only interpretive potential as weapons, these have to go back to the owners. As my earlier sarcastic post pointed out. Your drawers could be used to strangle someone, so I guess we have to have everyone strip off their drawers and hand them over. Reason must prevail.
