Well, I've recently learned that there's no percentage in airing my views of home defense, but I do have to remark: What is the deal with this fetish of entering other peoples' homes? It's not something I've ever even considered doing without an invitation. Even when I desperately needed a shower.

I wonder about the permissiveness of our society that embraces the squatter lifestyle BUT once the guy left, it's the police's job, not junior Wyatt Earp.

Oh, I get it. I'm pretty sure that by law, you can't get out of danger, then deliberately put yourself back into danger, then wax the guy. But I'm sure the experts will arrive soon to point out the dangerous lunacy of my line of thinking.

A lot of interesting and relevant information missing from the story. I would expect that. But, the shooter appears to have been ill-trained, ill-prepared, and/or, perhaps most importantly, too ready to shoot someone. Again, this is based only on a very superficial news story. It's only my initial, knee jerk reaction.
Can't argue with your conclusion aldecaker. I wouldn't bet on the outcome of the trial though. Particularity if it is a jury trial.

Seriously, the dude should have left the house, whenever possible, you should try to avoid/flee the location of danger. Call the police, then wait for them to arrive. At best, if you think you can and the man otherwise unarmed and trying to leave, detain him through a citizen's arrest.
One crime (break and enter) does not justify another one even worse (homicide).

Interesting case.
I think he lost his "self defense" claim when he left the scene. Had he been carrying the gun in the first place, he would probably have a much better chance of getting the self defense upheld.
I can think of a couple scenarios where leaving to get a gun and coming back and shooting an intruder would be justifiable, but this isn't one of them. Sounds like this guy has seen too many cowboy movies.
Just the opinion of someone who owns a large gun collection, lives in a self-defense friendly state, and would not hesitate to put down anyone who intruded into my home. I'm very much FOR people defending themselves, but this one seems like a no-brainer.
