I have unlocked and sat down into not my car before.
Reading quickly through the WA 'Use of Force' and 'Stand Your Ground' laws, and this guy has an up-hill battle.

Jury trial! Only need one on the panel to side with you. If your attorney can't convince one, the State has really great case or, and here's the kicker, either you picked a bad one to represent you or the judge did.
And, I agree. Based only on the news reports and a total lack of real facts, this guy will be doing some hard time. I hope he's not too pretty.

That is right, if you are guilty, you want a jury trial, if innocent you want a bench trial. But you keep missing the point--- I would sidestep the whole issue of defendant. Finding him in my shower, I would simply toss a power tool in there and let him electrocute himself.
Then take him out in the woods and leave him for the coyotes. At the very least come home an hour later and "find" him, report the break-in, that a stranger broke in, took a shower while playing with some electric hair dryer or something, it must have fallen in the tub and juiced him.
No harm, no foul, no fault. The coroner asks you some routine questions and takes away the body. They check him out and find he was stinking drunk. Case closed. Then you sue his family for the home damages.

Btw, electrical shock from a power tool or power anything went away in the 70's. Modern wiring protects people from themselves or angry wives.

There is a lot of discussion here that shows premeditation and intent. Hopefully none of these posters will ever drop a hammer on someone and then have the posts surface to be presented in a court by the prosecutor. Think! Think people! Think before you type. This stuff could really bite you in the butt should the unthinkable occur.

It's the thing the cops get a subpoena from your internet service provider for whenever they want to use it to prove a case against you. It is handily open to interpretation, kind of like a polygraph. If you fail a polygraph, you probably did it. If you pass a polygraph, it's possible to "cheat" a polygraph and you're probably a very clever bastard who did it. If you are in possession of these facts and refuse to take a polygraph, then you have something to hide and definitely did it! :rofl:

Browsing history is one thing. Statements made, even in jest, can take on a life of their own. Did the poster simply try to be cute or, were they demonstrating a proclivity to shot and kill. Power tools in the shower? Cute!
John's early statement about killing based on assumption with no fear of harm, etc. That's just grist for a prosecutor's mill which will grind very fine. Trust me. Phones, computers etc. will be carefully examined. A statement such as he made would definitely find its way into a trial. He could wipe his drives but, it's out there, in public and would be found fairly easily. It is undeniable that he will kill based on a preformed assumption.
Serious stuff indeed.

If they want to accuse me of something based on my wacky browser history I would have happened already. In my line of work I "google" some pretty intense stuff. I'm more concerned they'll talk to my crazy X wife. Lol
I understand Warrens point, but I'm not paranoid, I'm not saying he is either. I've been in court enough that I know the game. Yes, it's a game. It's not about the truth. If it were about the truth OJ wouldn't be in jail for stealing his stuff. He'd be in jail for slaughtering two people.

I don't think it's as much an issue of making accusations based on a browser history, but rather of using it to reinforce a conclusion they've already drawn. Let's face it, a prosecutor is not going to put you on trial if they haven't already concluded you are actually guilty (rare cases of prosecutorial malfeasance aside). Anything they can use to sway a jury to agree with their conclusion is pretty much fair game, as long as they do it "correctly", legally speaking.

It's about facts and testimony ideally. For the panel? Presentation is indeed an important consideration. And, if the prosecution screws it up, the gloves didn't fit, it's hard to recover. Never ask a question you do not already know the answer to. OJ's team simply embarrassed the prosecution with, I add, the prosecution's inept assistance.
Paranoia had nothing to do about. Circumstances do. Mad at the wife you tell a close friend, "I wish she was dead." Two days, a month later she dies somehow, not at your hand. Your friend mentions to the cops your earlier wish. You sir, are in for a very hard time. Hopefully with no charges. But you will have an attorney and fees and... it'll be your own fault. This isn't that farfetched a scenario.

It's about connecting dots when the story is told. Which dots get connected are part of the strategy for either the defense or prosecution.

My kids thought I was paranoid because I routinely cover the lens of my laptop's built-in webcam with tape. Right up until they saw a story on the local news about some jerk that got busted hacking webcams so he could ogle the users. Paranoid my ass!
