My state has "restitution" also. Here's the part you're missing, and I'll use an example I have personal knowledge of.n my state the repaying nonsense is called restitution. When you get convicted of a theft, you are required to pay that back and it is added to your court costs and fines.
Dope Head vandalizes someone's car, gets caught, gets convicted, and is ordered to pay restitution (to the insurance company). The victim filed an insurance claim and got the car repaired minus the deductible.
Dope Head has never paid a dime of "restitution" and is walking the streets like it never happened.
So, the victim is out the deductible and the insurance company is out the rest.
Dope Head of course doesn't have any money or a job, so no one is ever going to get a dime. Just because you get a "restitution" order, doesn't mean it will ever be paid.
I'm pretty sure Dope Head couldn't care less about having his license suspended either. So, do you support throwing him in jail and forcing him to work off the debt? Or should we forget about it and move on, because "it's just stuff".
