I just placed an order at Smokingpipes, and noticed a new tick box, informing me that I understand I am responsible for Pennsylvania Sales/Use Tax. Clicking on the "Read More" tab, I got this message:


Pennsylvania State Sales Tax


As of April 1, 2018, all online retailers, including Smokingpipes.com, are legally obligated to report taxable purchases to the state of Pennsylvania. Accordingly, we're required to inform you of the following:
(1) Smokingpipes.com does not collect Pennsylvania Sales or Use Tax;

(2) This purchase is not exempt from Pennsylvania sales or use tax merely because it is made over the internet or by other remote means; and

(3) the State of Pennsylvania requires that a Pennsylvania purchaser (a) file a sales or use tax return at the end of the year reporting all the taxable purchases that were not taxed and (b) pay tax on those purchases.

What does this mean for you? At the end of the year, we'll only submit to the Pennsylvania Department of Revenue the four pieces of information that they've required us to report: customer name, customer billing address, customer shipping address, and the total dollar amount of Pennsylvania purchases made by each customer during the previous calendar year.
Here's what we won't report: details about what you've ordered. We pipe smokers can be a private lot, so don't worry--we'll keep the details about what you've ordered just between us. And in order to help you Pennsylvanians satisfy your obligations to the state, we'll be providing you with an end of year summary as well.

Sadly, Pennsylvania is only the first of several states to look at doing this.

What is the sales tax for Penn residents? I would definitely let them chase me before I ever paid them anything.
6%. They won't chase you, they will ensnare you. As the owner of a small business, I know this. I used to be proud to be from Pennsylvania. Not so much anymore.

Pretty sure it ain't just tobacco or pipe sales.... How bout that $6,000 TV you just got from Amazon.
Most large internet retailers, including Amazon, collect state sales tax for all states.

Amazon has a physical presence in Pennsylvania in the form of distribution centers, so they have been collecting sales tax here for quite a while. But Smokingpipes does NOT have a presence. They just ship here.
I collect PA Sales Tax from my clients here in the state that are non-exempt. It's a pain in the ass and the state wants a lot of private information/paper work from me for the honor of doing that for them. But I don't collect on sales that are made to out of state clients. If I have to start collecting and filing sales tax for every state in the Union that I conduct business in, that is going to suck, big-time.

Exactly. Which is why it seems odd that SP is saying "all online retailers, including Smokingpipes.com, are legally obligated to report taxable purchases to the state of Pennsylvania."
Legally obligated by whom? The state? So, Pennsylvania can now regulate interstate commerce? I don't think so. SP should tell PA to pound sand.

Sea captain, in Ga the business has to have a distribution center/ or other brick &a mortar in Ga to collect taxes. We Anti Government types have GA locked down, so no worries as of right now. Will be watching those wascally folks in Atlanta, though. They fuck up, they lose their cushy government job.

They can't ever actually enforce you to collect for other states. That is the hold up on an across the board internet tax. Pennsylvania can't do diddly squat to me ever. I don't live there, nor do I have a business there physically. But, I occasionally do online purchases with Pennsylvanians. In fact, it's a "BOOO HISSS" to Smokingpipes for complying even a little bit with an out of state tax code. I can see warning their customers about possible taxes in their respective states, but to submit anything... They must have some screws to turn on Smokingpipes.com. Do you get this warning from making a purchase from P&C?

That may help you decide who you will do business with from now on. :puffy:

Up til now, states haven't been enforcing their legal rights to collect user taxes, but it's always been only a matter of time. Just hope they don't go after taxes owed retroactively, which they can also do if they so desire. That's why I've always paid my user fees. And up til now, I could deduct that payment from my federal tax. That's no longer the case.
