I can set up a home brewery/winery and produce um-teen litres of alcohol,
Believe me this is coming up more and more in homebrew circles in the states as homebrewing gets more popular the states legislators here are trying to in act possession laws because who needs 20 gallons of beer at one time and what about the children that live in that house. Oh please think of the children.

Fortunately homebrewing is now legal within all fifty states and the AHA stays on top of issues as they come up. In general, craft beer seems to have government support, possibly because it represents small business growth and did so even with a depressed economy. Thankfully, the craft beer movement is historically more closely linked to the homebrew community then it has been to the mega brewers.
In the tobacco world, pipe smokers and pipe tobacco seem to more closely resemble the craft beer market than the ABInBev or MillerCoors conglomerates. Getting the government to see past big, therefore evil in their mind, tobacco and look on the artisinal nature of pipes and cigars continues to be an uphill battle.

Crazy! You shouldn't be considered to be a retailer unless you are selling it. Seems like its mainly designed to ensure that are able to collect taxes on the tobacco. This is what happens when you decide to put a tax on a commodity. Everyone who uses the commodity starts to look like a potential tax evader to the government.
