A forum member who knows who he is on another forum, contacted me to tell me that he is selling a pipe using my name is doing it through Refreshing Pipes.

Anybody thinking about buying this pipe should know that I gave no permission for the use of my name, and this was done without prior knowledge from me. I asked that my name be removed from this offer. It's an inaccurate and misleading claim just sell a pipe.

Do I understand someone sent this pipe to the eBay seller to sell? I'm glad the eBay seller corrected the listing but wasn't impressed with the actual "apology" - passed the buck while noting he was getting record views? Kind of a BS way to handle it IMO. No excuses, really, for either but the person trying to trade on your name should be ashamed.

All he really saw were the extra hits so he figures it was good for him.

I seriously doubt the person who tried to trade on my name is ashamed at all. His PMs to me told me that when he claimed that my name is in the public domain because he saw it often when he did a Google search.

your name maybe your likeness nope. And I know how hard it is finding things like branded products on Google you know not being in the public domain and all.

People really just don't understand at all how anything works these days and don't bother looking anything up and just say whatever nonsense they think is the case. I'm truly baffled at the crap people think and how little they understand.

Every time I get online, this commercial constantly runs in my head whenever I start reading anything anywhere:

I know a lot of people have problems with the ebay platform, but the problem is the people. in this instance, hate the player, not the game. I don't like to begrudge people who are trying to make a buck, but there's a lot of saddening behavior happening with the pipe sellers on ebay these days. they choose to play the game like they do. nobody is forcing them to be this way.

The irony, of course, is the seller guy is now smiling all the way to the bank because of the fuss.

If Jim had just rolled his eyes at the listing and moved on, few would have noticed his name and fewer still would have cared. The low-end pipe market on Ebay isn't a full page ad on the back of Playboy magazine. (or whatever the functional equivalent is these days)

That’s the dumbest thing I’ve ever heard…

Misappropriation of name without consent cannot be justified because a particular name was found in a Google search. That does not make it public domain. This guy is just a hammerhead.

Couldn't agree with you more. He was just looking for an excuse to justify his bad behavior. I didn't respond to that particular PM becaue I had already stated my position, and wasn't going to go back and forth with him.

Maybe, as @georged pointed out, he got some attention from this, but considering the number of people who now understand how he practices retail, some of them won't do business with him. I figure he doesn't win any more than he loses. And his closing line in his so-called "apology" displayed his insincerity, which did him no favors. And perhaps others will think twice before trying something like that to me and to others. That's why I didn't ignore this one like I did a couple of times in the past (not by him).

That guy is an idiot.
Every time I Google "cartoon mouse," I get Disney's Micky Mouse. That doesn't make it public domain.

Just glad the guy removed his name. but it's unfortunate that this thread drove so many to go check out his listing.
