Doc, maybe if he was trying to actually make a product to sell... or, using this to sell anything at all. But, look through the website some. None of these companies mentioned are actually making any of the products or actually associated with these products.
All the more reason for Peterson to kill this and protect their brand image.

With this, from the designer:
"I got a mail from the peterson of dublin, they had some troubles through this concept design, people asking them about this pipe design. please do not contact them for information. This is an individual concept. :)
I apologise to peterson of dublin for my mistakes in using the logo without permissions."

Simple solution, buy the Peterson name, and make any abomination you choose, no?

Ireland takes such theft and infringement very seriously. Not sure how or why US patent laws were brought into the discussion. It is exactly at this time in his education that the student should experience such a teaching moment.
Disney is fairly benign in their dealings with such problems. It is only when the first few letters are ignored that the full power is unleashed. Of course that's when the press gleefully fires up the "David and Goliath" headlines.

Except for the Sherlock Holmes reference. It is probably considered public domain in the US but Peterson may still have an issue if it's in conjunction with a "pipe"

I'd be interested to know if the name "Sherlock Holmes" is still protected by trademark or copyright. I just don't have the initiative right now to look it up.

Yes, but did we succeed in actually crushing his dreams? I still wanna blindside the dirty rotter with some Cornell & Diehl like Tom suggested.

Surprise! It was me all along! ..And I would have gotten away with it if it weren't for you meddling kids.
Now send along that Cornell & Diehl. I'm ready for my penance.

I figured some nice tobacco would be better than a nasty cease and desist order! Might even lure the guy away from vaping, who knows?

This is actually quite interesting.
Most of the Sherlock characters and stories are now public domain, but a few stories from later in Doyle's career remain under CR.
So - Yes, and No, depending on what source material you're deriving from.
EDIT: And some references, because I know you fellas like that sort of thing.

And an article from TechDirt

It was a personal industrial design concept project by that designer. Behance is a creative portfolio website owned by Adobe. Infact in my line of work, we do a LOT of case studies and POC's for leading brands just to enhance the existing product design or present a new concept
