75% tax? I hate this state! Is this just for mail orders? Or just all tobacco products shipped to recipients in NY? I had to cancel an order because the tax was an additional $47.00! WTH!

So, when I visit out of state people, I should add B&M's to my list of places to site see? What other states are as bad as NY?

AFAIK (other New Yorkers, I am sure will chime in here) but B&Ms in New York, like just about every state, charge all taxes due to online customers whose billing address is in the same state as the vendor. All walk-in customers are also required to pay all those applicable taxes on their purchases made while at the B&M as well.

I get the sales tax. It's 8.9% in Erie county NY. But this is another 75% tax. Is there a 75% tax in every other state in the union or is NY pretty much the only one?

You only pay the Tobacco Tax if you order within your own state. In Vermont, the tax is 92%. If you order from any other state, you do not pay any tax at all. No Sales Tax and no Tobacco Tax. You simply pay the price listed on the website.

But it's not just your 8.9%. If you go to your local B&M, the additional NYS taxes are already added into the price. Then you get the regular sales tax. I think that's how it works. That's how $36 of tobacco turns into $100 out of your pocket.
Also, just an FYI, I have heard on the radio that the state either just passed or about to pass a law mandating the collection of online sales tax so if you go on a wild spree ordering from out of state, you might be forced to pay later.
There is a reason why George Mason University ranked NY dead last in freedom.

That's horrible! I try to be a small business supporter. This way the taxes I pay stay local. But, I like the idea of shopping on line. I'm very fortunate that I have a couple of tobacconists near me. But, why would I want to pay 75%? I can't imagine 92% dayam! That's excessive.

When I get my taxes done there's a questionnaire from NY State "Did you order anything online but didn't pay tax?" Or something like that.

I think NY is trying to recoup the taxes they're losing in the Indian Reservations by excessively taxing non-Native American tobacco users. In the name of "Increased health costs." It's messed up.

I can't speculate on what the future holds. I can only tell you that as of now, there is no tobacco tax or sales tax paid when you buy online from a state other than your own. This is true for most internet purchases, not just tobacco.
There is some serious talk in Washington about implementing an internet sales tax, but as of now there is no such law.
You can choose to claim internet purchases on your income tax return and pay the state tax due, but that's up to you.

In New York State it is true that there is 75% tobacco tax and I am pretty sure it is on all tobacco products. In New York city the B&M is out of the question since there is a high city tax on some tobacco also (i.e. A pack of cigarettes is almost $13.00 a pack, not a fan of cigarettes but its crazy).The unfortunate part is it ultimately hurts companies located in NYS. The other option is to ship it to someone out of NY and have them then ship it to you with all of the shipping costs its still cheaper. Living in Brooklyn,NY, lets just say the internet in my friend.

The questionnaire actually asked, this year, what counties, other than Erie and Niagara Counties, in NY I've shopped in. Luckily, I don't really go anywhere. But I remember thinking "How intrusive!"

Online shopping hurts state sales tax revenue. Many states use sales tax as a major source of revenue, so they are trying to recover that. Add on to that the ever popular "sin taxes" on alcohol and tobacco, and there you have it.

I get that, and try to buy local. Even down to my hair dresser, I went from a national chain to a local hair dresser. I like to support local business. I really do feel that one supports their community by supporting local businesses. On the other hand, I don't have a limitless supply of disposable income. This is a tough spot for me to be in :/ The state runs on sin taxes and dummy taxes (speeding tickets) and taxes on the gullible (lottery)

Maryland tobacco tax is now at 35% and I no longer patronize state tobacco vendors. When they passed this silly law last year, I emailed my state representatives and warned them this would be my plan . FortunateIy I live within 5 miles of PA or WV. MD raised the aalcohol tax to 9 % last year as well and our gas tax goes up in July. Guess where I buy those items.

I have family in different states. I will start adding B&Ms to my sight seeing list ;)

I'll start looking for new souvenirs. I can PAD and TAD to my list along with QFAD (Quilt Fabric Acquisition Disorder) and WAD Wine Acquisition Disorder. There are a lot of new vineyards in NC.

I don't blame you for not shopping in MD.

Misu, I live in Warren County NY and am a stones throw from P&C, Park Lane and Cup O' Joes storefronts. As much as I like to shop local, as regards tobacco, I just can't afford to on a regular basis. Paying 50 bucks for something I see online at the same establishment selling for around $20 is just to hard to swallow (not the retailers fault!). Did you know that this great state of ours has a tax form where you are supposed to record your out of state tobacco purchases and pay the applicable NY tax? So if I cross into Vermont or you into PA for a Sunday ride and buy a pack of cigs or pouch of Redman at a Mobil station and we pay the VT/PA tax at the register, NY wants its pound of flesh too!
Edited this a bit... paranoia about the thought police set in. 2+2=5 and all that... :|

I live in Arkansas and have no B&M's near... do all my tobacco buying on-line. As of yet I've paid no

tax, but I know it's coming! My $10 dollar tins will be $30 bucks as soon as they can.... I hate it!

If memory serves, a $22.00 can of Holiday Excursion sold online at P&C cost me around $48.00 at their store locally. So yeah Top, 10 will be the new 30 someday!
