I've been working my way through the shows and am currently at episode #151. I've heard Brian sporadically state "You must be 18 to listen to this show." I realize the show was probably advised to insert this phrase for legal reasons but when I hear this I think to myself "Are we really this sensitive as a society that discussions about tobacco are deemed inappropriate?" Is it necessary to caveat the show like this?

Are there alcohol related podcasts that use phrases like this? I don't listen to any so I don't know.

Maybe my gripe is more about censorship and the sue-happy judicial system we have in the US. It just irks me that someone thought it was necessary to inert this phrase.

Love the show and this post is by no means a criticism.

Embers, I think you're taking my point to the extreme and out of context. As far as I know there are State Laws preventing minors from entering liquor stores. There are state lwas preventing underage people from purchasing tobacco and alcohol. There are also laws preventing underage people of entering certain adult "dance" clubs. In these examples, the underage person is physically present at the establishment, not simply listening to the radio. As for the adult movies, the internet granted access to people of all ages to almost anything.

The point of this thread was to inquire why it is even necessary to use the phrase. I'm not aware of any laws preventing people of any age listening to a radio show. Is it a legal "cover your ass" move?

It's just a disclaimer much as newer ID checks for tobacco purchases say that the customer must appear as 40 years or older.

The phrase doesn't bother me at all. I get uncomfortable if a minor even walks up to me while I am smoking... but, I'd rather the little gutter snipes stayed away from me regardless. puffy

You'll find that directness achieves a result that no amount of subtlety of action will.

A surplus WWII flame thrower works total wonders at chasing away---and keeping away---not just gutter snipes, but pretty much anyone you encounter who displeases you with their comments or unwanted attention.

My kids are allowed in the bottle shop here in New Zealand, and one time my 5 yr old girl got given a packet of PK by the clerk, so now every time we drive past the liquor store she says "Oh I think you deserve some more Papa juice, we should stop and buy something".
