This is really the facet of the regs that I did NOT see coming. If you'd have told me that the selling of something as innocuous as a hand-carved wooden pipe would be regulated out of existence, I wouldn't have believed you.

Amazing, ain't it? By what legal alchemy does a wooden object become a tobacco product and therefore subject to FDA deeming? Yet there it is. I'm hoping that the legal challenges blow this particularly obnoxious overreach out of existence.

But they are not pipes. They are "Hand Carved Decorative Items" :D

By the same legal alchemy that has produced the countless other violations of Constitutional law over many decades. The only real solution is a holistic one. The States created the nightmare we call the federal government, and the States need to abolish it completely and start over imo.

Not true. A number of the Signature Series blends were on the market prior to the predicate date.

This is the truly evil part of the deeming regulations. A manufacturer can go through the arduous and expensive process of completing an application to the FDA for approval of a blend that they strongly believe will pass muster, pay the $30k application fee, and then not be approved. No application fee refund, no approval, SOL. Who in their right mind would take such a gamble?
Also, please keep in mind that the pre-2007 blends are not safe from the FDA's purview. The FDA has stated recently that they reserve the ability to examine ALL tobacco products, including those grandfathered. They simply have not chosen to do so at this time.

It isn't just H & H that's affected. Many of Pease's most popular blends are post deeming date, including a personal favorite, Gaslight. The Dunhill's have been re-released during that time. Crown Achievement changed its formula and McClelland's Balkan Blue changed its name from Blue Mountain and I believe that makes it subject to the fees and testing also. No more special small batches like Christmas releases or reserves. And now the artisan pipemakers are competing w/ tobacco blenders over our hard earned dollars for the next two years

@Woodsroad- Yet another sad reminder that everything you are allowed to do is at the pleasure of the government. Your "rights", your "priveleges", all an illusion, subject to revocation at the discretion of a government agency.

McClelland's Balkan Blue changed its name from Blue Mountain and I believe that makes it subject to the fees and testing also.

Actually, the name change isn't really an issue with Balkan Blue. It was released at the same time as my BlackHouse - right after the 2011 Balkan Sobranie 759 Throwdown, so the date alone is likely to kill it.

The problem I am having is I don't want to cellar anything I haven't smoked. I now have 72 4oz mason jars filled with about 45 different blends.
At the rate I smoke, I am gonna have to live to be 106.
I have commissioned another pipe from Ryan Alden, Just in case they are serious.
