Germain/Esoterica- No Warning Labels

How is it J.F. Germain & Son is able to get away without Nicotine warnings on their blends?

I thought all tobacco products in the West, USA, Europe, etc., had to be labeled with these warning?

The only thing on their blends are California State Warning(s).

Pretty sure they dropped that law last year. Everything I've purchased this year had no labels.

Warning labels were struck down by the courts a few years ago. The FDA didn’t do the required research to install such a request per their own rules, so until they do, the labels on cigars and pipe tobacco is unenforceable.

Every country has different requirements with regard to health warning and labels. Not all require pictorial warnings, not all have to say about nicotine. There are sometimes requirements for certain size and type of font, requirements for how much of package the label must cover and so on. This is why orders are made specific for each country sold to, so the tobacco is properly and legally labelled for that particular country.

Old, health warnings have been in place for years and years. Every single tin produced and sent out has health warnings and has done for many years.

Nothing has been dropped. If anything getting more stringent.

This was what I got from a B&M. On the dry side, that explains the age. Still great though. Keep up the great work Gawith!

@gawithhoggarth I understand about the requirements, but I see differences in regards to Nicotine warnings.

To be honest, I wasn’t paying close attention to some of the tins I was recently buying. Many of them made in the USA and imported into the USA do not have Nicotine warnings on them.

The Nicotine warnings is what I was trying to understand, as to why some companies are putting them on, and some aren’t, as it concerns the USA Regulation(s).

I have bought a lot of tins from different companies in the past, with no Nicotine warnings.

All the the tins that I see don’t have Nicotine warnings, instead have a California state warning.

@gawithhoggarth forgot to mention, the way I see it, you are not required by USA Law, to put the Nicotine Warning in big bold letters, or even on both sides. It can be a small warning on the backside. I see many companies only put a small label, printed in small text on the back.

You should look into this and just put a small warning on the back.

Here are two tins I just purchased from an online USA retailer for Dan Tobacco and Solani, imported from Germany, with only a small warning on the back.

I don't mind Prop 65 warnings. My brain has gotten really good at filtering them out by this point!

We are well aware of the exact warning and labelling requirements required for each country. This is something we work closely with with each distributor we work with for each country. America has different requirements to Europe.

Each company also has their own requirements as to how labels are added, whether it can be done by machine or by hand, it can depend on the tin and packaging used.

@gawithhoggarth, what year did you start putting warnings on the tin? Trying to date the tins I recently bought without warnings as shown in my last post above.

All I’m saying is, if other companies from overseas, that are imported into the USA, I assumed Gawith didn’t need the nicotine warnings either, and you could also put just a small California warning. Which amounts to less printing and less money spent by Gawith.
