Deeming Regs

Brian recently said a court struck down the FDA's reg regarding the labeling of tobacconists as manufacturers. He's jumped the gun, I'm afraid. What the court did was tell the FDA its legal grounds for that reg were weak and that it must come up with other grounds. Alas, it ain't over yet.

Perhaps the issue will disappear into the bureaucracy and not resurface. Not likely, but it has happened before.

I was reading that on Tobacco Business. If they took up as much of a fight on tobacco as they did on lets say Meth or Heroin the country would be way better off right now.

Not if you are a meth or heroin user. Of course neither is analogous to tobacco usage or government regulatory decisions. If we stick to the OP's subject we can avoid politics.

Was not trying to make it political. Many have tried in the past but we seen how that turned out.

It's already political to begin with. It's about federal bureaucracy regulations. To discuss it at all is to have a political discussion.
And the obvious parallels with all other government regulation of "substances" are certainly germane to the discussion. IMO.

It's not that difficult to figure out. We're allowed to discuss tobacco legislation. Stick to the facts about tobacco legislation without a bunch of pointless asides and all is good. Fail to do that and the thread will get closed. Do enough screwing around with the topic and the topic may eventuallyl get closed.
