Yeah, that one shares the same grey area as Pirate Kake. You can buy it buy the pound, yet it doesn't classify as "bulk". I can remember being able to buy it by the oz at one point.
Strange back when I bought pirate kake and nighttrain they were bulk. This was before the changes in regulation though

I believe stores can no longer weigh out an ounce or other weight from another bag, it has to come from the manufacturer in pre weighed bags
I would imagine if that was the case then no bulks would be able to be sold. How would it affect one blend but not another?

It has to do with how the blend was originally sold. If it was available to retailers in a five pound wholesale bulk bag, then they can continue to sell it loose to retail customers. If it came in a one pound retail packaging, it must remain in that one pound package. If a retailer breaks that one pound package, then they would be repackaging, which is verbotten. None of it makes sense. The rules were written by people who do not understand the business and detest tobacco. That's as much clarity as I can add here.

Ah I think I understand; what they call it/what it’s intended for determines whether it can be sold as bulk.

The fact that the wholesale bag is 5 lbs. means that it can be sold in small quantities. Since the 1lb. bag is labeled for retail it cannot be broken down further.

If this is true then they could sell it at bulk if they sold it, for example, a 1 lb. size bag. In the opposite way they could label a 5 lbs. bag as retail then they couldn’t split it into bulk.

I wonder why things need to be labeled wholesale vs. retail. Taxes?

I’m not an expert on such things, but I do know that the deeming regulations deal with packaging , labeling and naming, among other things, and that thy were written by bureaucrats who don’t know and don’t care that they don’t know about tobacco.

Taxes are a separate issue, but do not limit packaging.
