Yep. One of the first thoughts I had after reading through the Rules was recipe books!

A practical FDA administrator would circumvent the whole pipe tobacco discussion since the agency has enough fish to fry for the next 20 years -- opioids, vaping, prescription prices, imported pharmaceuticals, food borne illnesses, and the list goes on to several hundred important topics each of which effects hundreds of thousands or millions of people. Dawdling around about pipe tobacco blends constitutes gross negligence.

No enforcement or even selective enforcement would constitute "negligence". Overly enthusiastic enforcement would be simply a PITA. Regulations and new laws are often used for increased staffing. And every "bureaubrat" loves having more staff.
