In NY recent legislation will amend the Penal law to automaticity upgrade the charge of assault on anyone over the age of 65. Ex. Simple assault 3rd is a catch all that includes threats, no serious touching similar to Disorderly Conduct. The upgrade from a Misdemeanor to Felony makes it a more serious charge, often jail time.

seems a bit reactionary and also a bit of a good idea. To my ears it sounds like a good idea that could have been thought out better. I mean now you get in a yelling match with grandpa cause he's grump bastard and boom a felony. I hope I am wrong about that and it's worded in such a way that isn't going to blow up bad but minor things into something far worse then the crime it is punishing. Remember that if it's worded in a certain way it doesn't matter if that threat is one that anyone takes seriously or not including the person you're making it at.
I also feel like it's a reaction to that horrible recent case that you can look up if you want. And the thing is won't do a dang thing to prevent something like that from happening.
Again like lots of legal things how it's worded is going to go a long way towards it being the right thing or something that does more harm.

In Florida an assault of the elderly person increases the misdemeanor assault to felony assault.

Felony assault can be met with deadly force.

The trial and subsequent acquittal of a gentleman in a movie theatre ended in a belligerent individual taking the sticky floor temperature challenge.

not to be crass but is that an assumption or have you actually read the wording of the law? It makes a difference and that difference is certainly and most likely aren't the same thing :). Heck sometimes laws are worded so poorly they do the opposite of what they're intended to.
On top of that reporting on laws is so often very poorly done. The number of times I've read about a law and what it means and the person doing the writing either is totally not qualified to write on the subject or is a big fat liar means I'd need more fingers then certain multi limbed deities have.

I was born and raised in New York City (Flatbush, Brooklyn to be exact). It’s just my gut instinct, that’s all. And you’re not being crass, you’re being straight forward. New Yorkers like that.

BTW, I no longer live there because I’ve experienced enough of this kind of insanity (caveat: I still love my city and my people; and miss them both, dearly).

Last I heard, in New York city you get arrested and you're back on the street, no bail. Not picking on NYC, it happens in many cities. The law has good intentions but to get the DA to prosecute and a judge to actually sentence the perpetrator is another story. Nowadays you can burn down whole business districts if your feelings are hurt and the cops will stand by and make sure no one interferes with your tantrum.

I find it somewhat disconcerting that various parts of the country find it important to keep creating special classes of victems instead of simply vigorously enforcing existing laws. I suppose it's simply because enacting laws is much cheaper than properly funding enforcement, judicial and prisons. Voters seem to embrace mindless laws over paying the financial costs of the proper delivery of public safety.

I have a Korea Vet friend whom at the age of 82, buckled the knees of a man half his age with one punch— then escorted him to his car and told him to sit there until he recovers enough to drive again. At 65, my friend might have killed him. Arbitrary nonsensical law.
