Man, I never thought the I'd see the day some jackass in high heels would go to a flippin concert and then complain about smoke!
To offer another perspective:
My oldest daughter is allergic to tobacco smoke (among other things). Being around it for extended periods of time literally makes her ill. I remember very well taking the kids to an indoor concert before there were any bans, and she became ill from the smoke.
Should people who have health problems like this be forced to stay home from concerts? That seems to be the logical consequence of your statement.

Places that serve alcohol are licensed by the state. Places that serve food have to pass inspections from the county health department (at least, that's who does it in Michigan).
I think the guy is a jackass for complaining to the health department. If the steps were:
1 Rock lit a cigar
2 Somebody complained to management
3 They asked Rock to put it out, and he did
that should be the end of the issue.
