So, if I am a retailer facing this same issue, why don't I buy constantly from my other B and M stores? And pay the taxes?
I've asked myself this question a thousand times. With tobacco products, its easy. The tax is usury (sp?) and completely out of touch with life as it is; it is punitive plain and simple, and for me, easy to ignore.
With other products, I find that I am just as human as the rest of the folks. i want the best deal as my clients do, and most of the time when presented with an ultimatum of 'match this price or else' i will determine the service potentially that the item will need and decide accordingly. A 'non-service' item means that most likely I will have nothing more to do with it-a service item means that I will have to be responsible for its upkeep (after all, 'we bought it from you!' the client may say).
Equalling the tax (or removing it entirely, -- yeah, right) amongst all states somehow will level out the playing field, and internet sales may slack off slightly and give the B and M a fighting chance.
