No matter the political BS, think about the corporations and insurance companies. Was picked for a random drug test and sure enough they check for nicotine. I wonder if they check the pee in the cup to determine if I had sex last night too.

RANDOM test? Didn't think they could ,legally, unless you are in a safety sensitive position like commercial driver or police officer. This is distressing!

Distressing? In what way? One usually agrees to such when accepting employment. If one can't abide the rules then one should seek employment with an entity that doesn't not have such rules or labor agreement.
Moses: If that's not true, you'd most likely be hunting for work else where.

Dumb question: How long does nicotine stay in the body (or bodily fluids) at a detectable level, i.e. what is the half-life? I don't have a dog in the fight but just curious.

If the nicotine test is a urine test, you should be clean within 2-4 days of your last smoke. For heavy smokers, it might take a week (and possibly longer) for the cotinine traces to leave your urine or remain so small that they are undetectable.

Don't have a problem with a drug test I am a programmer at a large insurance company. Wonder if soon they will be sending auditors to my home searching for fire arms, pressing my nuts to see if I am breeding, or checking my colon for fiber in take. I am after all nothing more than a human resource. And once they use that up, they will be looking for souls. It's the cost of Anglo civilization :p

Personally, I think this is outrageous. I understand 29 states have passed laws prohibiting it, and the other 21 should follow suit. Lobby your representative.

My work randomly screens for illegal drugs. That was a known condition for initial and continued employment. One that I accept.
Screening for a legal substance, like nicotine is dubious, because the test doesn't know where the nicotine is from. I assume they are screening for smoking cigarettes and assuming inhalation and we all know that puffing on pipes or cigars, chewing, or gum represents a different level of risk.

Wondering if any company also screens in a helpful manner, i.e., for markers that might indicate a medical condition that when caught might save a life or two.
Being retired, the only entity interested in my urine is my Labrador. He thinks it's extraordinary, so much so that it inspires him to piss on top of it.

Is there a policy against smoking at your job? Seems odd they would test for that unless there was some reason you were not allowed to or that they would be penalizing you on insurance rates.

Along comes me with the Medicinal Tobacco to treat my Bipolar I Disorder. Better believe I would find a way to be stubborn about it. Pro choice to smoke way too much. Wonder how long the 9 bowls of tobacco and 12 cigarettes I smoked yesterday stay in my system lol. I understand the reasons.....but the logic is flawed.

Corporations are private property and therefore when you sign a contract with them for employment, you do so on their terms. It's not your job, it belongs to the business, Nicotine test may not be smart business practice, I wouldn't do that to my employees.

This is false.
Just as owning private property doesn't entitle one to a mini fiefdom, corporate contracts do not preempt your rights. There are plenty of firms that handle nothing but contract disputes it's just a matter of how far you want to go.

Sorry bigpond, nobody said anything about fiefdom, it's a popular theory socialist use to disrupt private property rights. How about I come to your house smoke pot in your living room, and tell you it's my civil right to do so. Like hell that would happen, big pond you would invoke your proivate property rights. That's what businesses are doing, invoking their private property rights. Smoking isn't a civil right, it's a right that you practice on your time.
