Is this true? I'm due to go to New Orleans for the first time in Feb. I was hoping to escape NY's restrictive tobacco laws and be able to smoke in at least some outdoor areas. Demmet!

City Council voted in the ban today. It looks like their going to put enforcement on the health department rather than the police, though.

Yes it passed but will not be implemented for 90 days...also Burbon Steet is exempt, additionally, Harrahs Casino is working on getting exempt and Harrahs has confirmed that this new law will not affect the New Orleans Pipe Show in November...we will still be allowed to smoke throughout the show in the venue.

Is this an in public thing or a private establishments can still allow smoking? Because the Cigar shops and bars I can imagine being upset by this.

Yep I've been on top of this...Harrahs is ensuring me that we have nothing to worry about.

Cigar bars and not included with this, and 99% of New Orlean's hotels had already gone smoke free back in 2012/2013...

Also, outside areas of restaurants, bars, and casinos will still allow smoking...and private groups and trade shows can apply for a city permit once a venue approves the event.

That is good news about the show, but bad news for property rights in NOLA.

Whew! Maryland law is administered much the same way. It protects the employee (not customers). As far as I know, it's never been enforced but everyone just complies. Our law has been on the books about 15 years.

You would think they would focus on more pressing problems like stopping people from pissing in the street .

Hotels and landlords love "no smoking" laws. It takes the onus off of them and saves them a bunch of money in paint, cleaning, repairs, and etc. We smokers are a smelly lot capable of setting a bed on fire, burning a desk and, much like canines and some other animals, we tend to mark our territory with a particular scent. Face it, we are not a popular bunch of people.
On the plus side, you can meet a few of the locals once you find where the employees hang out and smoke. Of course it's usually in an alley in the back of the hotel.

I wonder how that will work? Will health inspectors give us tickets for smoking or just rate us a 50 on our inspections and tack the paper to our chest? ha ha.

Just another unenforceable law. Have you been to New Orleans? Imagine trying to set rules on those folks. ha ha!!When I first visited back in college there was a dead bum on the street in front of our hotel for two days before anyone removed the body. And, it's the only place I have ever seen real illegal drugs being used, and that was only because they were being used out in the open on the street. I think I will walk down any street with my pipe in my clench with no fears, just like any other day, ...with my feathered loincloth, ha ha!!

The inspectors will probably document violations and the businesses will have to answer at license renewal time. It's an incentive for the business to police itself. Much easier and more effective than citing the smoker which could clog minor courts and various hearing officers..

Is this saying you cannot smoke whilst walking down the street? That bit doesn't sound right.
Here in Australia you cannot smoke indoors at any public building, even tobacconists, can't smoke in a car whilst carrying anyone 16 years or under (police fine of $500) and cannot smoke within about 30-40 feet from a supermarket entrance or any entrance to a shopping centre, restaurants etc. however we can smoke whilst walking down the street, even in the city centre.

Up here in Anchorage, I believe the latest rule is "no smoking" within 50 feet of a business entrance. This precludes smoking on the sidewalk in the business district on most any block. I'm guessing public parks will be next with state parks to follow.
If the current law is strictly enforced then smoking in an automobile parked on the street in the business district is also prohibited. It's an extreme of course, but as a cop I'd sure use the law as a "tool of the trade" if I wanted to "jack" someone up and that was the only probable cause available.

I remember the Haitian bellhop that showed us to our room just a few years ago... I had about two thousand dollars in camera gear, so I asked him if the room was secure. He said, "ya mon, just shove de towel under de door when ya smoke your dope." I quickly took my camera gear and stored it in the trunk of my car. This was a nice hotel. And, the couple in the room next door grilled their dinner on a charcoal grill that they set up in the middle of the room. I've also seen what looked like twelve year old hookers.
I don't think banning smoking is going to fix anything that's wrong with that city. A lot of my jewelry business is for the Mardis Gras Court, so on years they can't come see me, I have to go down there. On the books, you aren't supposed to do about 90% of what you'll see going on down there. I really want to see the guy buying a pre-teen girl, with a rhino horn necklace, and a human kidney in a cooler while shooting up heroine, get in trouble for smoking at the bar. I'll have to make a special trip down there just see how this works, ha ha.
